Do I have to go to court to get divorced in New Jersey?
No, you do not always have to go to court. If you and your spouse are able to reach a full agreement on all your issues without the need for the court’s help (whether through mediation, negotiation, or other forms of alternative dispute resolution) then it is possible for you to resolve your divorce without ever stepping foot in a courtroom! If this is a priority for you, book a free consultation with our team today to learn how our New Jersey divorce attorneys can help you navigate this path.
What is divorce mediation?
Mediation is an alternative method of dispute resolution that takes place outside of court. A divorcing couple works with a neutral third party called a mediator who helps facilitate productive, respectful discussion with the goal of reaching agreements on all the issues. In some cases, especially when custody and visitation disagreements are involved, New Jersey courts require couples to attempt mediation before moving forward with a trial. However, many couples elect mediation in an effort to save time and money, protect their privacy, and maintain control over the outcome.
What is the difference between a contested divorce and an uncontested divorce?
An uncontested divorce can take place when a couple agrees on all of the important issues (such as child custody and support, asset and debt division, alimony, etc.) without the need for court intervention. On the other hand, if a couple does not agree, or only reaches a partial agreement, they must ask the court to make the final decision in a contested divorce.
How much does divorce cost in New Jersey?
The cost of a divorce varies depending on the complexity of the case and whether it is contested or uncontested. In general, uncontested divorces tend to cost less, as they involve fewer legal disputes and court proceedings. Contested divorces, on the other hand, often come with higher costs due to litigation, attorney fees, and extended courtroom battles.
How long does divorce take in New Jersey?
Divorce timelines in New Jersey also vary between cases, as they, too, are dependent upon how complex the divorce is and whether it is uncontested or contested. However, uncontested divorces are often able to be resolved much faster because they do not require the court’s intervention, and can take as little as 5-8 weeks. Contested divorces tend to take longer and are also dependent upon how backlogged the courts are, so they can take 10-12 months or more to be resolved. It’s important to note, though, that the state of New Jersey requires that the courts disallow the process to exceed 12 months.
